These Terms of Use (“Terms”) govern your access to and use of the Workplace Case Leads website, firm portal, booking tools, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Description of the Services
Workplace Case Leads provides marketing and exclusive lead-generation services for California law firms in workers' compensation. The Services may include this lawyer-facing website, firm inquiry forms, a firm portal, prepaid wallet deposits, campaign administration, and a booking page. Features may change over time. Public pages do not list lead prices; commercial terms for firms are set in a separate joint advertising or services agreement, not on this site. This website does not host a consumer case-evaluation form for injured workers; consumer inquiries are received from generators and advertising vendors for delivery to purchasing firms.
Not a law firm, legal advice, or government services
Workplace Case Leads is a marketing company. We are not a law firm, not a certified California lawyer referral service, and not affiliated with the State Bar of California, any court, or any government agency. Nothing on the Services is legal advice, an advertisement for a specific legal result, or an official government communication. For legal questions, consult a qualified California-licensed attorney. We do not analyze a consumer’s legal problem in order to select, rank, or recommend a lawyer. When a consumer inquiry is associated with a campaign, it is delivered to the law firm that ordered that campaign.
No attorney-client relationship
Use of the Services, including submitting a firm inquiry, booking a call, or creating a portal account, does not create an attorney-client relationship—or any other professional relationship—with Workplace Case Leads. Communications with us are not privileged. Any attorney-client relationship, if one is formed, is solely with the independent law firm that contacts the consumer after a lead is delivered.
Lead quality, accuracy, and verification
We aim to screen and deliver exclusive inquiries, but information submitted by consumers, generators, or firms may be incomplete, outdated, or incorrect. Geography, representation status, claim facts, and contact details can change without notice. Firms are responsible for independently evaluating each inquiry, confirming conflicts and licensure, and deciding whether to contact or retain a client. Consumers are responsible for verifying the identity, office location, and advertising disclosures of any law firm that contacts them.
No endorsement and no guaranteed results
A firm’s appearance on this site, in the portal, or as the recipient of an inquiry does not constitute an endorsement, referral, ranking, or guarantee of quality, availability, or outcomes. Results described in marketing materials are not a guarantee or prediction of a consumer’s outcome or a firm’s results. Submitting a request or paying for leads does not guarantee signed cases, recoveries, or any particular volume of qualified inquiries.
Third-party law firms, generators, and websites
Law firms, lead generators, payment processors, scheduling tools, and other vendors are independent of Workplace Case Leads. Their websites, professional duties, and policies (including privacy, billing, and advertising) apply when you interact with them. Cal.com handles booking on the book-a-call page. Stripe processes prepaid wallet deposits. We are not responsible for third-party content, actions, or omissions, including a firm’s handling of a consumer matter after delivery.
Firm inquiries and booking
Firm inquiry forms and the book-a-call page are provided for convenience. Submitting a request does not guarantee an appointment, a response, a delivered lead, or any particular outcome. When you submit firm information through our site, we process it as described in our Privacy Policy. If you consent on a firm form or booking flow, Workplace Case Leads may contact you by phone, email, or text (SMS), including with automated technology. Consent is not required to request information. Reply STOP to opt out of SMS where supported.
Consumer advertising for a specific firm must identify a responsible California-licensed attorney or firm and a bona fide California office location, and must follow SB 37 and related rules. Firm customers will execute a joint advertising agreement covering advertising content, lead quality, replacement, and pricing.
Firm portal and prepaid wallet
Portal access is for authorized firm personnel only. You are responsible for account credentials and for activity under your login. Prepaid wallet deposits are marketing fees for lead generation, not a division of legal fees or a percentage of any recovery. Refunds, replacements, and pause rights are defined in your firm agreement. We may suspend or terminate portal access for nonpayment, suspected abuse, or violation of these Terms.
Acceptable use
You agree not to:
- Use the Services in violation of law or regulation;
- Attempt to gain unauthorized access to our systems or other users’ data;
- Scrape, overload, or interfere with the operation of the Services;
- Misrepresent your identity, firm, licensure, or affiliation;
- Present Workplace Case Leads as a law firm, as a certified lawyer referral service, or as having evaluated a consumer’s legal problem in order to select counsel; or
- Use consumer contact information we deliver except to evaluate and pursue the inquiry in compliance with TCPA, privacy, and professional conduct rules.
Intellectual property
The Services, including text, graphics, logos, and layout, are owned by Workplace Case Leads or our licensors and are protected by intellectual property laws. You may not copy, modify, or distribute our content without permission, except as allowed by law or for personal, non-commercial use consistent with these Terms.
Disclaimer of warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WORKPLACE CASE LEADS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100), TO THE EXTENT PERMITTED BY LAW. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED.
Indemnity
To the fullest extent permitted by law, you agree to indemnify and hold harmless Workplace Case Leads and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
Governing law
These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles, except where preempted by federal law. You agree that state and federal courts located in California will have exclusive jurisdiction over disputes arising from these Terms or the Services, subject to applicable law.
Changes
We may modify these Terms at any time by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
